🔍 Episode Overview:
At around 12:55 PM on July 5, 2023, Officer Nicola Costagliola from the Neptune Township Police Department was patrolling in plain clothes near 10th Avenue and Atkins Avenue. He spotted a 2005 Nissan driving erratically. As he television the vehicle, the driver sped up suddenly, screeching its tires. The driver then took a wide turn onto 7th Avenue, prompting Sergeant Letsch to activate his lights and pull the car over. Officer Costagliola approached the driver, who was later identified as Marcie. While talking to her, he detected the smell of alcohol and saw signs that she might be impaired. Suspecting she was intoxicated, officers asked Marcie to step out of the car and perform field sobriety tests.

The first test was the Horizontal Gaze Nystagmus (HGN), but Marcie didn’t cooperate during the procedure. She then tried the Walk and Turn test but failed to touch heel to toe properly and made an improper turn. The last test was the One Leg Stand, and Marcie couldn’t keep her foot up correctly or finish the test without putting it down early.

Due to her reckless driving, the smell of alcohol, and her poor performance on the tests, Officer Costagliola placed her under arrest for DWI. Her car was towed and held for 12 hours under John’s Law. During the arrest, officers searched her vehicle and found an open container with alcohol inside. Officer Benites arrived to help with the search and then took Marcie to the police station for processing.

At the station, she was read her rights and initially agreed to give breath samples. But she refused to cooperate with the Alcotest, which led to a charge of refusal. After processing, officers took her to Jersey Shore University Medical Center for additional evaluation. Officer Costagliola then issued several tickets, including charges for driving under the influence, refusal to take a chemical test, reckless driving, failing to stay in marked lanes, not wearing a seatbelt, and possessing an open container.

Records show that Marcie was already arrested for DWI in Millstone Township, New Jersey, on April 19, 2015.
