The court session presided over by Judge Mogen centered on the case of State of Wisconsin vs. Andrew Koti. Initially, the hearing was set for a plea and sentencing agreement. Assistant District Attorney Holly Rockau explained that the deal required Koti to plead guilty to one count of misdemeanor disorderly conduct, with remaining charges dismissed and read in. Both sides recommended court costs only ($443), citing that Koti had already been revoked in Polk County for other serious offenses and would remain in custody.

However, the situation changed dramatically when the victim, identified as SB, gave a powerful and emotional statement. She detailed a year-long abusive relationship filled with escalating violence. According to her, on October 21–22, 2024, Koti assaulted her multiple times—breaking car parts, damaging her glasses, seizing her phone, and even bashing her head against the car window. She described living in constant fear, suffering anxiety, panic attacks, and requiring ongoing therapy. SB requested 90 days in jail, no-contact provisions, firearm restrictions, anger management, drug treatment, and probation, stating that she feels unsafe and traumatized.

Judge Mogen observed that the criminal complaint was very brief and lacked these critical details, which likely led to the original plea offer. After hearing the victim’s testimony, Judge Mogen expressed that a cost-only sentence would not serve the public interest. When questioned, Koti denied provoking a disturbance, leading Judge Mogen to reject the plea agreement and schedule the case for trial.

The trial was set for June 24, with May 19 as the final deadline for any plea agreement. Judge Mogen made it clear that after this date, no deals would be accepted and the case would proceed to trial, where the state must prove its allegations beyond a reasonable doubt.
