Leaving the Scene of an Accident Resulting in Death — Florida Law, Jury Instructions, Penalties, and the Consequences of Cowardice

Under Florida Statute § 316.027(2)(c), a driver who is involved in a crash that results in the death of another person has a legal duty to remain at the scene. This includes providing information, rendering reasonable assistance, and waiting for law enforcement to arrive. Leaving the scene under these circumstances is a first-degree felony.

The elements of the offense include that the defendant was the driver of a vehicle involved in a crash, the crash resulted in the death of another person, the defendant knew or should have known they were involved in a crash, and the defendant willfully failed to stop and remain at the scene as required by law.

According to Florida’s standard criminal jury instructions (28.4), the prosecution must prove beyond a reasonable doubt that the defendant was aware or should have been aware of the crash, that the crash caused or contributed to the death of a human being, and that the defendant willfully left without fulfilling legal duties such as stopping, providing personal and vehicle information, rendering aid, or notifying authorities. If all these elements are satisfied, the jury is instructed to return a verdict of guilty.

Leaving the scene of a crash involving death is a first-degree felony, punishable by up to 30 years in prison, with a minimum mandatory sentence of four years. It also includes revocation of the driver’s license for at least three years and fines up to $10,000. A conviction results in a permanent felony record, which can devastate careers, reputations, and future opportunities.

Ironically, cases involving DUI manslaughter or vehicular homicide often present more avenues for defense than a charge for leaving the scene.

This is because DUI manslaughter involves scientific evidence. Blood alcohol levels must be established, chain of custody on blood samples can be challenged, toxicology labs can make errors, and accident reconstruction is subject to interpretation. People conduct these tests — and people make mistakes.

An experienced defense attorney can expose flaws in procedure, timing, science, and testimony. There is room to fight.

But leaving the scene? That’s a decision. A choice not clouded by BAC levels, lab protocols, or reconstruction diagrams.

Fleeing the scene of a fatal crash is not just a legal misstep — it’s a moral collapse. The moment you leave someone to die alone on the pavement, the case becomes more than about laws. It becomes about who you are.

One path shows humanity — staying, helping, calling for aid.

The other shows cowardice — abandoning someone in their final moments, hoping to evade consequences.

And juries recognize that. Judges do too.

Because while science can be questioned, character cannot be cross-examined away. And cowardice often brings conviction.
