While over 60 million eligible americans are still waiting or in the dark on when or if they’ll receive their stimulus payment there’s an unsuspecting group that you would never guess are having an easy time receiving their payments. The dead.

Thousands of deceased people are receiving stimulus checks. According to Market Watch more and more reports are coming in from spouses and children of deceased people who are getting the $1200 deposit.

Why is this happening?

The IRS determines eligibility based off of your 2019 tax return, if there is not a 2019 return available they base it off of 2018’s taxes. The IRS has no system in place for the stimulus checks in order to ensure the recipient is actually alive. According to Leonard Burman, the co founder of Urban-Brookings Tax Policy Center, The IRS largely relies on the SSA for up-to-date death records but that information could take anywhere from a few months to a year or more to trickle in after someone’s death. https://www.cnbc.com/2020/04/17/irs-s...


If a deceased person fits the stimulus check criteria of gross income below $75,000 for single filers or under $150,000 for couples, they have a SSN, and aren't a dependant on someone else’s taxes. They are due to receive the $1200 or $2400 payment respectively depending on the speed of their death certificate.


There are examples of people who had a loved one die in 2018 and they are still receiving the stimulus payment on USA today Rep. Thomas Massie, R-Ky., who shared an image of a text from a friend that read, “Dad got his stimulus check of $1,200. He died in 2018. It’s not clear how many dead people have received this stimulus payment but

This isn’t the first time the federal government has issued stimulus checks to the dead. More than 71,500 dead Social Security recipients received $250 stimulus payments under the American Recovery and Reinvestment Act totaling just under $18 million of the $13 billion of the stimulus package in 2008.

This has been especially common with spouses in a situation where the bank account used to accept a tax refund is still open.

So what happens to those who receive a payment for a deceased person?

This is where it gets interesting

It’s looking like the deceased or their dependents will about be able to keep these over payments due to a lack of refund stipulations in the CARES Act.

That leads us to the next question: What are the deceased allowed to spend their $1200 on? Well that’s the eternal question isn’t it..

Will the IRS keep that money or is a surviving family member entitled to the funds?

This is an interesting proposition because really they’re no less entitled to the funds than the group of people who received the funds from a deceased family member.

This may apply to someone who for example earned $50,000 in 2018 and $120,000 in 2019 but has not yet filed for taxes in 2019. That person isn’t technically qualified to receive the stimulus payment however there is not yet a record of them being disqualified. According to this rule it seems that this group of people may also be entitled to keep their stimulus payment.
In summary it is leaning towards the IRS having to let people get what they get even if that means they don’t qualify. So if you’re a high income earner or dead person watching this may the odds be in your favor to keep your stimulus payment.
