Recently, a war of words has broken out between the Opposition INDIA bloc and the Chief Election Commission (CEC) of India. The bloc has even hinted at moving a motion seeking the removal of CEC Gyanesh Kumar. But can the CEC really be removed? According to the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, the CEC can be removed in the same manner and grounds as a Supreme Court judge. That means, through a motion passed by a two-thirds majority in both Houses of Parliament. And to even initiate the proceedings India bloc would need the support of at least a 100 members of the Lok Sabha or at least 50 members of the Rajya Sabha. Given the current numbers, the bloc’s chances of removing the CEC are slim. The move, therefore, seems more symbolic, a way to register protest against the CEC’s conduct, similar to their notice last year seeking the removal of then Vice-President Jagdeep Dhankhar. But the question remains — is the CEC acting in its true spirit of independence?
