Although a first offense DWI is usually a misdemeanor, it is still considered a serious infraction in the state of Texas which is punishable by fines, license suspension, probation and jail time. You may be responsible for a $2,000 fine to the county of your arrest as well as a $6,000 fine to be paid to the state. You may also be sentenced to community service hours ranging from 24 to 100 hours. Your license may be suspended for up to a year, or you may have to pay substantial annual fees to keep your license. Jail time can range from three to 180 days behind bars. In some cases, a judge may sentence you to a maximum of two years of probation in lieu of jail time. You may also have to complete an alcohol education course. More severe sentencing may be imposed based on the results of the chemical blood, breath or urine test that was used to test your blood alcohol content. If your BAC was 0.015% or higher, you will be charged with a Class A misdemeanor, which carries with it the same penalty as a second offense DWI: two years in jail, and a $4,000 to $6,000 fine. You may then be required to have an ignition interlock device installed on your vehicle, at your expense, for all of part of your probation.
