15 दिसंबर 2025 को सुप्रीम कोर्ट ने प्रॉपर्टी खरीदारों के हक़ में एक ऐतिहासिक फैसला सुनाया है, जो हर उस इंसान के लिए बड़ी राहत है जो जमीन या मकान खरीदने का सपना देख रहा है।

इस केस में एक खरीदार ने 78 एकड़ जमीन खरीदने के लिए लाखों रुपये एडवांस दिए, लेकिन बाद में पता चला कि वही जमीन बैंक के लोन में गिरवी रखी हुई थी। सेलर ने एग्रीमेंट में झूठ बोला कि प्रॉपर्टी पूरी तरह क्लियर है, जबकि ओरिजिनल टाइटल डीड्स बैंक के पास थे।

हाई कोर्ट ने खरीदार को ही दोषी मान लिया, लेकिन सुप्रीम कोर्ट ने साफ कहा —
👉 अगर सेलर ने एनकम्ब्रेंस छुपाया है तो खरीदार दोषी नहीं है।
👉 ओरिजिनल डीड्स न देखना खरीदार की गलती नहीं मानी जाएगी।
👉 धोखे से ली गई एडवांस रकम ब्याज सहित लौटानी होगी।

जस्टिस विक्रम नाथ और जस्टिस संदीप मेहता की बेंच ने यह भी कहा कि सेलर की सफाई सिर्फ “afterthought” थी, यानी केस हारने से बचने की चाल।

यह फैसला हर प्रॉपर्टी खरीदार के लिए एक मजबूत सुरक्षा कवच है।

On 15 December 2025, the Supreme Court of India delivered a landmark judgment that brings major relief to property buyers across the country.

In this case, a buyer paid a huge advance for purchasing 78 acres of land, only to later discover that the land was already mortgaged to a bank. The seller falsely declared in the agreement that the property was free from all encumbrances, while the original title deeds were lying with the bank.

While the High Court blamed the buyer, the Supreme Court clearly ruled:
👉 A buyer cannot be blamed if the seller hides encumbrances.
👉 Not checking original title deeds is not negligence when the seller promises to provide them later.
👉 Advance money taken through fraud must be refunded with interest.

The bench of Justice Vikram Nath and Justice Sandeep Mehta termed the seller’s defence an “afterthought” — a desperate attempt to escape liability.

This judgment sends a strong message:
Property fraud will not be tolerated, and buyers are legally protected.
