This case is about a lawsuit against the Consumer Product Safety Commission for not releasing data on accidents caused by televisions under the Freedom of Information Act (FOIA). The Court of Appeals found that a previous judgment in a reverse-FOIA suit did not prevent non-parties from litigating their contention that the FOIA requires disclosure. The issue was whether dismissal on a theory of stare decisis, collateral estoppel, or comity was appropriate. The court rejected these alternatives and decided that non-party requesters retain their right to sue for enforcement of the FOIA. The case was remanded to the District Court to determine if the failure to release information was improper and to decide on appropriate relief.
