📖 CASE BACKGROUND

On February 29, 2024, Dustin Duren shot and killed Caitlyn Naffziger—the mother of his two daughters—in their Berlin, New Hampshire apartment. That much is not disputed. What is disputed is why.

The State charges Duren with first-degree murder, second-degree murder, reckless conduct, and child endangerment. Prosecutors say Duren shot Naffziger during an argument, ripped his 4-year-old daughter from Caitlyn's arms, then fled 170 miles to Keene with both children, triggering an Amber Alert. The prosecution's theory: "This is a case about anger, anger and control."

The defense claims Duren was protecting his children. They say he reasonably believed Caitlyn was about to kidnap their daughters, and under New Hampshire RSA 627:4, deadly force is justified to prevent kidnapping. Defense attorney David Rothstein told the jury: "Dustin, a Marine veteran, responded to a threat when he shot Caitlyn one time."

This is not a whodunit. This is a why-he-did-it. The jury will decide whether Duren murdered Caitlyn Naffziger—or whether he was justified in using deadly force to protect his children from what he believed was an imminent kidnapping. The State must prove beyond a reasonable doubt that his belief was unreasonable.
