California law (Penal Code 459) defines burglary under Penal Code 459 PC as "entering a structure with the intent to commit a felony (or a petty theft) once inside". It can be charged regardless of whether force or violence are used. Robbery (Penal Code 211) is when you use force or violence or threats of violence to take property from the immediate possession of the victim.
