On November 16th, 2022 at 8:29 pm Ohio State Highway Patrol responded to an incident in Fairborn, Ohio. The incident involved Sgt. Peter Fekkes of the Indianapolis Metropolitan Police Department who was found slumped over at the wheel of his blue Jeep after hitting a red truck. OSHP troopers arrived on the scene where Sgt. Fekkes was placed in handcuffs in the back of a police cruiser by another police department officers doing an event that night and handed the investigation over to OSHP.

The other police department informed OSHP that they found Sgt. Fekkes slumped over in the driver's seat of the blue Jeep which had hit a red truck. The officers knocked on the window to wake Sgt. Fekkes who remained unresponsive. When Sgt. Fekkes did awaken he refused to leave his vehicle and had an “obvious smell of alcohol” and was mumbling to officers. An opened bottle of vodka was also found inside the vehicle that was “right next to him”. Empty beverage cans were also seen on the floor of the Jeep but officers could not confirm if they were alcoholic beverages.

OSHP troopers went over to the back of the police cruiser where Sgt. Fekkes was handcuffed. Sgt. Fekkes seemed argumentative with the first trooper. The second trooper began persuading Sgt. Fekkes to exit the police cruiser stating “I don’t want to take you to jail tonight.” The trooper stated, “I understand what's going on, I can smell it come from your breath” to which Sgt. Fekkes began to comply and began exiting the police cruiser with some difficulty. When the trooper asked if Sgt. Fekkes would be willing to do a Field Sobriety Test he began the testing briefly before shaking his head and looking away from the trooper. The trooper began to explain “Whether or not you refuse it does not predicate if you go to jail. Your attitude determines that with me.” he later stated, “As long as you’re polite and cooperative, I’ll work with you to get you home?” Sgt. Fekkes did not perform any further Field Sobriety Test tasks with the trooper.

The OSHP trooper then switched out the other police department's handcuffs with OSHP's own handcuffs to which Sgt. Fekkes complied. The trooper then read Sgt. Fekkes his Miranda Rights after changing the handcuffs. Sgt. Peter Fekkes was given a summons and charged with 3 misdemeanors, Failure to Control, Open Container in a Motor vehicle, and Failure to Wear a Seatbelt.

Sgt. Peter Fekkes joined the Indianapolis Metropolitan Police Department in February 2002. IMPD reports he has been disciplined in the past. IMPD is still working to release Fekkes' disciplinary report at this time. The department said had received praise and had previously in 2016 received a certificate of commendation. At the time of writing his next hearing will be in January 2023 at the Fairborn Municipal Court.
