Richardson v. Chapman | 676 N.E.2d 621 (1997)

When a young woman is disabled for life, significant damages are appropriate. But when does significant veer into excessive? The court in Richardson versus Chapman had to decide whether a jury’s award to an accident victim went beyond what justice required.

Keva Richardson and Ann McGregor had just graduated from college when they met at the American Airlines flight-attendant training program and decided to room together in Chicago. Late one night, while were riding in Richardson’s car, they were struck from behind by a semi-trailer truck driven by Jeffrey Chapman. McGregor escaped with minor injuries, but Richardson was severely injured. Her neck was broken, resulting in complete paralysis below the waist and only partial control over her arms and hands. Her face was disfigured. For the rest of her life she would require assistance with basic tasks, including dressing, eating, and emptying her bladder and bowels.

Richardson and McGregor sued Chapman and his employer. Richardson’s expert predicted that her future medical costs would be at most about 9.5 million dollars. The jury awarded Richardson over $22,000,000, including $11,000,000 for future medical care, as well as amounts for disability, disfigurement, and pain and suffering. It awarded McGregor over $100,000 for pain and suffering. The appellate court affirmed. Chapman appealed to the Illinois Supreme Court, arguing that the jury’s award of damages was excessive.
