Law firm breakups involving the division of pending contingent or deferred fees can often lead to a dispute over the division of the fees when they come in. Lawyers may rely on their right to assert an attorney charging lien on the matter in these cases because the payment of the fee comes from the proceeds of the case. In this video podcast, we talk about some of the issues that are raised when an attorney attempts to use a charging lien to recover a contingent fee in a federal court case.

There are no statutory charging liens in cases that arise under federal law. The issue of when and how to assert a charging lien, including whether the attorney must bring the lien claim before the case is resolved and whether there must be an independent basis for federal jurisdiction.

The focus of the discussion here is a decision from the Third Circuit Court of Appeals enforcing a charging lien after the client changed attorneys.
