The Supreme Court orally observed last week that "reservation cannot be on the basis of religion". The Bench of Justice BR Gavai and KV Viswanathan was hearing a challenge to the May 22 Calcutta High Court decision which struck down reservation for 77 communities (classes) - 75 of which were Muslim - within the quota for Other Backward Classes (OBC).
पिछले सप्ताह सर्वोच्च न्यायालय ने मौखिक रूप से कहा कि "आरक्षण धर्म के आधार पर नहीं हो सकता"। न्यायमूर्ति बी.आर. गवई और के.वी. विश्वनाथन की खंडपीठ 22 मई को कलकत्ता उच्च न्यायालय के उस निर्णय को चुनौती देने वाली याचिका पर सुनवाई कर रही थी, जिसमें अन्य पिछड़ा वर्ग (ओबीसी) के लिए कोटे के अंतर्गत 77 समुदायों (वर्गों) - जिनमें से 75 मुस्लिम थे - के लिए आरक्षण को रद्द कर दिया गया था।
