WHAT IS A PROBATION REVOCATION HEARING IN NEVADA?

If you have been placed on probation for a felony in Nevada, you will be ordered to abide by certain conditions. Examples in Nevada include going to counseling, taking a drug program, maintaining employment or schooling in Nevada. Whatever the terms are, you are required to obey all laws and report to your Nevada probation officer...

If you do not adhere to the conditions of your probation in Nevada, your probation officer will file a report with a judge seeking to "revoke" (cancel) your probation. You are then entitled to a hearing where a Nevada judge will decide whether to revoke the probation. This is extremely important because a revoked probation could potentially result in a long prison sentence in Nevada.

A defense attorney's objective when going into a Nevada probation hearing is either 1) to argue to the judge that you did not violate probation, or else 2) to talk with the probation officer or prosecutor prior to the hearing to see if a resolution can be worked out where the probation can be reinstated, perhaps with additional terms but without prison. One of the most common conditions in Nevada is that the defendant "stay out of trouble" during the pendency of the criminal case. Sometimes defendants pick up new arrests just weeks or days before a case is set to close--that is why it is so important defendants have counsel to try to persuade prosecutors and the judge to simply close the case instead of imposing a suspended sentence in Nevada.
