How can you avoid jail time for a third time DUI in Florida? Third time DUIs are problematic for a number of reasons, but there are often mandatory jail time imposed for those DUIs. For example, for a third time DUI within 10 years, there's a mandatory 30 day jail sentence. However, there are strategies that we can put into place to try to avoid that 30 day time altogether. One of those strategies includes inpatient treatment, and another strategy is trying to get that DUI charge reduced from a third -time DUI to another charge such as a reckless driving. If the DUI is outside of 10 years, then there's not a mandatory 30 -day sentence, but oftentimes courts and the prosecutors are going to be looking for jail time just because the fact that case is aggravated. Again, we can try to work to reduce or eliminate that jail time altogether.
