Today I am going to be talking about the disturbing news regarding UK Visa delays which are ‘causing rent, employment and healthcare issues’
With the tenth anniversary of the government’s hostile environment imposing greater penalties for landlords and employers who fail to conduct immigration checks, it is pertinent to consider those that have been metaphorically ‘left by the wayside’ whilst they wait for the Home Office to process their application.
At present, the Home Office have a propensity for blaming the ongoing delay on the shifting of priorities to process Ukrainian visa and asylum applications as well as employing the exhausted excuse of a backlog created by the COVID-19 pandemic. The delays are now so bad that applications that would have been considered within 6 months a couple of years ago are now taking almost a year on average. Please note that some of my clients have been waiting for more than two years for a decision!
Many of those who are awaiting an outcome for their visa application will be placed on what is known as 3c leave.
This little statute of the Immigration Act 1971 purports to protect the rights of an applicant however outside the scope of immigration law this concept is scarcely understood.
This often causes issues with oblivious employers, academic enrolment officials and landlords who refuse or are unaware of how to carry out the relevant checks and demand that the candidate produce a valid immigration document.
Far too often my clients encounter issues as a result of these delays and their 3c status. Employers are often reluctant to carry out checks on behalf of a viable candidate and will more often than not opt for a candidate with valid immigration documents.
A candidate’s immigration status is not considered as a protected characteristic under the Equality Act 2010 and so an employer is completely within their rights to make decisions on this basis. This further adds to the lack of protections available for those with this type of leave.
It has also not gone unnoticed that there are extant government delays in the processing of right to work checks themselves – if the protections that are put in place for those with 3c leave are subject to delays then it is called into question how the government expects those with this type of leave to survive whilst their applications are considered. Long story short, its time to snuff the politics and drama and to just sort it out.
