Today I have Elise Rodriguez, and she is an attorney with Life Long Law (www.lifelonglaw.com). She focuses primarily on estate planning, but she has done probate work as well.

So, why is an estate plan beneficial, and who can benefit from an estate plan? Estate planning is not only for the wealthy. You don't need a lot of assets to form an estate plan. Planning can be focused on medical decision-making, or the handling of a will and trust.

Elise also says that people think that they can avoid probate with a will. This is not necessarily true, because a will only states who you want representing you, and where your assets will be heading. A will must be probated.

A trust allows you to put your assets and your requests into a vehicle. You have more control over how and when your beneficiaries will receive your assets with a trust as opposed to a will.

Once you have a will or trust in place, you should have it reviewed after every major life change. Big life changes are good times to take a look at the estate plan. If nothing else, one should review his/her estate plan every three years.
