FIRST-DEGREE ARSON

Under CRS 18-4-102, first-degree arson is defined as burning a building or occupied structure owned by someone else. This can include the arsonist’s own home if he or she is a tenant or has a mortgage.

There are several possible legal defenses to first-degree arson charges. Three common ones include:

1) The fire was an accident,
2) The owner of the building or occupied structure consented to the fire, or
3) The defendant played no role in causing the fire

Common evidence in these cases includes eyewitnesses, surveillance video, recorded communications, and testimony by forensic fire experts.
First-degree arson is the most serious of Colorado’s four arson crimes. It is prosecuted as a class 3 felony, which carries 4 to 12 years in prison and/or $3,000 to $750,000 in fines. But if the arson involves explosives and causes a serious injury, the potential prison sentence becomes 10 to 32 years.
