How I Choose a Best Doctor from the Georgia Workers Compensation Panel

When you are hurt on the job, you have the right to choose a doctor from a list of doctors your employer (and their insurance company) have selected to appear on something called a "posted panel of doctors."


Under the law, your employer gets to choose the doctors on the panel. Usually your employer's insurance company advises your employer who to include on the panel and, not surprisingly, most of the doctors on the panel will be BIASED in favor of your employer.


Generally speaking, they will be quick to return you to work full duty and they will delay or refuse to order diagnostic tests.


Given that the doctors on the posted panel may not have your best interests at heart, you have to be strategic in choosing a doctor. That's where I can help you.


As I discuss in this video, there are some doctors I frequently see on posted panels that I would never advise you to choose. This may be because I see their reports in other cases and I know that these doctors never find anything significantly wrong with any injured workers. They frequently return seriously injured workers back to full duty work regardless of their injuries. #hurtatwork


Second, some posted panel doctors may not be the right choice for you because they don't specialize in your injured body part. For example, if you hurt your shoulder, you need an orthopedist who works on shoulders, not one who focuses on knees.


The insurance adjuster assigned to your case assumes that you do not have much knowledge or experience choosing a doctor for a work injury. They will take advantage of you. The adjuster works for an insurance company whose primary goal is to save money and return you to work. They are not interested in your long term health.


As your attorney, my focus is to get you to a doctor who will offer treatment you need. If there is a doctor on the panel who I know to be reasonable and a good choice for you, I will advise you to switch to that doctor.


If there are no reasonable doctors on your panel, I will use tools available to me under the #georgiaworkerscompensation law to get you to another doctor. This may be through negotiation with the adjuster or defense counsel, the claimant's IME (independent medical exam) or by petitioning the State Board of Workers Compensation for change in authorized treating physician.


I urge you NOT to guess when choosing a doctor from the posted panel of physicians! I also urge you to speak up if you sense that the doctor who is treating you for a #workinjury is not helping you get better.
