Criminal Speeding in Arizona is a Class 3 Misdemeanor. This offense is criminalized in A.R.S. 28-701.02 and can be committed 3 different ways:
(1) If the driver exceeds the posted speed limit in a business or residential district by more than 20 MPH, or if there is no posted speed limit, it is criminal speeding for a driver to exceed 45 MPH;
(2) A driver exceeds 35 MPH approaching a school crossing zone;
(3) Driver exceeds 85 MPH in other locations.

Unlike a civil speeding ticket, a criminal speeding conviction is not eligible for defensive driving school ("DDS"). As such, a goal in the criminal speeding ticket representation is to negotiate a reduction to a civil offense with the prosecutor. The benefit of DDS is that completion of it results in a dismissal of the civil traffic ticket.
