After Surfside, the Legislature passed sweeping condominium safety laws that many felt were a rush to judgment. The law contained glaring ambiguities and left boards and managers with more questions than answers. Recently, SB 154, the “Glitch Bill,” was enacted to fill in some of those gaps. Our panel of community association lawyers will review the key provisions of the Glitch Bill and assess whether the Legislature hit the mark. We will cover clarifications about who can perform safety inspections, what condominiums are impacted, new inspection deadlines, and how the safety inspection process will be enforced. Our panel will review revisions to the Structural Integrity Reserve Study (SIRS) process, and changes to reserve funding rules. Finally, we will discuss how the law impacts the fiduciary obligations of condominium directors, officers and managers.
