The court's decision is likely to have thrown the independent counsel's corruption investigation off course.
To dissect how this will impact the proceedings, our Ji Myung-kil turned to two law professors for their views.
The court's decision could be a setback in the independent counsel's efforts to investigate President Park Geun-hye's alleged involvement in a string of charges against her confidante Choi Soon-sil... and how Samsung fits into the picture.


"I think the independent counsel team will have more work to do in gathering evidence since the court ruled it there was insufficient reason to arrest Lee Jae-yong for bribery."

Samsung Electronics vice chairman Lee Jae-yong is facing allegations of bribery, embezzlement and perjury.
The counsel team had sought to tackle the corruption scandal by treating Lee's succession at Samsung Group as the key to the case, but may now have to reconsider its approach.


"The independent counsel can resubmit its request for an arrest warrant for Lee Jae-yong and could also seek warrants for other company executives for the first time as well."

Both professors said it was unlikely the ongoing investigation would lose steam in the wake of the court's decision.

The team has been concentrating on the financial transactions between Samsung and Choi Soon-sil, the woman at the heart of the scandal.
Lee is accused of directing funds to foundations controlled by Choi in exchange for government support for a controversial merger of two Samsung affiliates in 2015.
The merger was seen as a critical first step in preparing for the transfer of management rights to Lee from his father.
Samsung has said it was forced to make the donations and did not seek special favors in exchange.
