Welcome to Drishti IAS in Audio Articles. The post of Attorney General is mentioned in Article 76 of the Indian Constitution. Thus, it is a constitutional post, and it has been given a special place in the Indian Constitution. It is the first law officer of the Government of India, i.e. the Attorney General is the highest law officer of India. It is also the chief legal advisor of the Government of India and this is the reason that whenever the government gets stuck in any legal matter or is in a state of doubt, it takes advice from it in such a case. Along with this, he is the chief lawyer of the Government of India in the court and works to present its side in various courts. In this way, he has the right to hear in all the courts of the country. An interesting thing about the Attorney General is that he is neither a member of any House of Parliament nor a member of the Cabinet, but he has the right to participate in any House. Along with this, he also has the right to participate and speak in parliamentary committees. However, he does not have the right to vote. In the Indian Constitution, it has been taken from Britain. In Britain, the post of Attorney General is of both legal and political nature. There it is recognized as the legal officer of the government, but he is elected. Whereas, in India it is only a legal officer. In India, instead of being elected, he is appointed by the President. It is worth mentioning that the definition of the post of Law Officer is given in the Law Officer Rules and Conditions Manual. In this three officers, i.e., the Attorney General of India, the Advocate General of India and the Additional Advocate General of India are considered as Law Officers. Let us tell you that the name of the first Attorney General of India is MC Setalvad.

दृष्टि IAS ऑडियो आर्टिकल्स में आपका स्वागत है| भारतीय संविधान के अनुच्छेद 76 में महान्यायवादी पद का उल्लेख है| इस तरह यह एक संवैधानिक पद है, और भारतीय संविधान में इसे एक विशेष पायदान पर रखा गया है| यह भारत सरकार तथा प्रथम कानून अधिकारी है, यानी महान्यायवादी भारत का सर्वोच्च विधि अधिकारी होता है| यह भारत सरकार का मुख्य कानूनी सलाहकार भी होता है और यही वजह है की जब भी सरकार किसी कानूनी मामले में अटकती हैं या फिर संदेह की स्थिति में होती है, तो ऐसे मामले में इससे सलाह लेने का काम करती है| इसी के साथ ये न्यायालय में भारत सरकार का प्रमुख वकील होता है और विभिन्न न्यायालय में उसका पक्ष रखने का काम करता है| इस तरह ये देश के सभी न्यायालय में सुनवाई का अधिकार रखता है| महान्यायवादी के बारे में एक रोचक बात ये है की यह ना तो संसद के किसी सदन का सदस्य होता है और ना ही मंत्रिमंडल का सदस्य होता है, लेकिन इसे किसी भी सदन में भाग लेने का अधिकार होता है | इसके साथ ही उसे संसदीय समितियों में भी भाग लेने तथा बोलने का अधिकार होता है| हालाँकि इसे मत देने का अधिकार नहीं होता| भारतीय संविधान में इसे ब्रिटेन से लिया गया है| ब्रिटेन में महान्यायवादी का पद विधिक और राजनीति दोनों प्रकृति का है| वहां इसे सरकार के विधिक अधिकारी के रूप में मान्यता प्राप्त है, लेकिन इन निर्वाचित होकर आता है| जबकि भारत में यह केवल विधिक अधिकारी होता है| भारत में इसके निर्वाचन की बजाय राष्ट्रपति द्वारा नियुक्ति की जाती है गौरतलब है की विधि अधिकारी पद की परिभाषा विधि अधिकारी नियम व शर्तें नियमावली में दी गई है|
