In tort law, an "act of God" is an event that is considered to be beyond human control or foresight, such as natural disasters or extreme weather events. Acts of God are often invoked as a defense by defendants who argue that they should not be held liable for damages caused by such events because they could not have reasonably foreseen or prevented them.

The key characteristics of an act of God defense include:

Unpredictability: Acts of God are events that are typically unforeseeable and beyond human control. They may include natural disasters such as earthquakes, floods, hurricanes, tornadoes, lightning strikes, and other catastrophic events.

Exclusivity of Cause: An act of God defense requires that the event in question was solely caused by natural forces, without any human intervention or contribution. If human actions or negligence played a role in causing or exacerbating the event, the act of God defense may not apply.

Break in Causation: The occurrence of an act of God must break the chain of causation between the defendant's actions (or inactions) and the resulting harm or damages. In other words, the defendant's conduct must not have directly caused the event, and the event must have been the sole proximate cause of the harm.

No Liability: If an act of God defense is successfully established, the defendant may be absolved of liability for damages resulting from the event. This means that the plaintiff may not be entitled to recover compensation from the defendant for losses caused by the act of God.

It's important to note that the availability and applicability of the act of God defense may vary depending on jurisdiction and the specific circumstances of the case. Courts generally interpret and apply the defense based on legal precedent and principles of fairness and justice.

In practice, determining whether an event qualifies as an act of God and whether the defense applies can be complex and fact-specific. Courts consider factors such as the foreseeability of the event, the defendant's duty of care, and whether reasonable precautions could have been taken to mitigate the risk of harm.
