The New South Wales government has lost its latest legal challenge to stop the threat of strikes on Sydney's rail network, putting the city's showpiece New Year's Eve firework event in jeopardy.

An application was made for a hearing yesterday afternoon but was refused by the Fair Work Commission.

The matter will be heard alongside a separate hearing on Christmas Eve.

The rail union is blaming the government for inciting fear rather than solving the ongoing pay dispute.
