Paguusapan natin dito ang mga mangyayarin kapag ang Agricultural Tenant ayaw gamitin ang Right of Preemption/Pre emption or Right of Redemption
Pwede ba paalisin ng bagong landowner ang tenant at bayaran ng Disturbance Compensation by invoking his right of ownership and that he or a member of his family is now going to personally till the land?
What is Disturbance Compensation? When is this allowed?
Reasons why the buyer wants to purchase the agricultural land:
1. He wants to become a farmer
2. He wants to develop it to residential, commercial or industrial
What are the rules for each reasons before the buyer may not problematically purchase the agricultural land?
Oftentimes, buyers of agricultural lands do not conduct due diligence in knowing whether there is a tenant or none. Do not just agree to the explanation of the seller that there is none. You have to conduct ocular inspection on your own and view for yourself the existence of such tenant in the eyed agricultural land. Diligent efforts must be exercised to the extent of inquiring from from the barangay where the property is located including the neighbors adjacent to the land whether or not there is an existing agricultural tenant working or tilling on the land.
Tenants of agricultural lands enjoy land security tenure and could not be dispossessed except in some rare instances allowed by law and order by the court.
