Hello, my name is David Badanes. I am a matrimonial and family law attorney with offices in Northport, Garden City and New York City. This video will give a brief explanation of child support in New York State.

The parent that is awarded custody or if there is joint custody, you are the parent the children live with most of the time, you will be entitled to receive child support from the other parent.

Child support is based on a formula. There are several child support calculators that you can find on the internet, including one on the Badanes Law website.

To obtain an estimate of your child support obligation, take your gross yearly salary and subtract your yearly Social Security taxes paid and your yearly Medicare taxes paid. The result of this calculation is called your Child Support Standards Act Income. You will note that the Child Support Standards Act Income is usually much larger than your net income or your take home pay.

If you have 1 child you multiply your Child Support Standards Act Income by Seventeen Percent, with 2 children you multiply by Twenty-Five Percent, with 3 children you multiply by Twenty-Nine Percent, with 4 children you multiply by Thirty-One Percent, and with 5 or more children you multiply by Thirty-Five Percent. The result of the calculation will be your yearly child support obligation. To find your monthly obligation, divide this number by Twelve.

In New York State, you are obligated to pay child support for your child until he or she reaches the age of 21 years of age.

Although, there is a formula for calculating child support, there are a few modifications that can be made that will either increase or decrease the actual amount of child support that you have to pay.
