**Can I license my trademark and can I make money from it? **

As you know, I'm doing my makeup in the car, so that means we get to chitchat.
the answer to that is if you do it correctly.
if you do it incorrectly, like technically, I guess you could make money from it, but you could also lose your trademark. So we don't want to do that.
Trademark licensing can be extremely lucrative. I mean, ask any brand like DISNEY™️ or MARVEL™️ or I don't know,
literally any brand that works with Target.
But
if you don't have the correct agreements in place, not only are you risking like losing control of the product and or not actually getting paid and or not getting paid what you thought you were gonna get paid,
but
you can actually lose your trademark.
That is obviously the absolute
big time problem that we are trying to avoid
If you're licensing your trademark without very specific language about quality control and rights, goodwill, that kind of thing,
it could be called a Naked license.
I actually got a blog post on this,
that Naked license. If somebody decides they wanna challenge you, they can utilize that naked license and say, Hey, this person isn't actually monitoring their quality and their, source so
they don't deserve this trademark.
If you remember correctly, trademarks are about protecting consumers. So
if somebody's alleging, hey, they're not actually protecting consumers, they're just letting anybody use this trademark willy-nilly that wants to pay them,
the USPTO is not gonna be happy
and they're probably gonna revoke your trademark if it's challenged.

Anyway,
if you get challenged at the USPTO, it's called a cancellation proceeding.
Those get very expensive and it's kind of like a little miniature lawsuit. You won't be, like fined money, but the USPTO can actually cancel your trademark.
if you're planning on licensing your trademarks, make sure you get a licensing agreement in place that is well written and covers all the things that need to be covered to avoid being a naked license
because we worked really hard for those trademarks and a beautiful brand is a terrible thing to waste.
