The rise of the gig economy is changing the way businesses engage their workers. The term ‘gig economy’ refers to a flexible labour market. There are no employers or employees. Instead, independent contractors are engaged on a task-by-task basis with no guarantee of ongoing work. Gig work offers a great alternative to a standard 9-5 routine.

You are probably already familiar with companies that embrace this new working model. Gig work is most common in the food delivery industry. It is used by digital platforms such as Uber or MenuLog to pair workers with specific tasks. Because of COVID-19, more people are turning to gig work to replace or supplement their income.

Australia’s workplace laws distinguish between two types of workers - employees and independent contractors. An employee is engaged by another person or business whereas a contractor is typically self-employed. The question of a worker’s status will depend on the facts in any given case. If a dispute arises, a court will examine the whole of the relationship between the worker and the business that commissions their labour.

Working arrangements between gig workers and digital platforms do not fit neatly within either category. For that reason, businesses must exercise caution to avoid the dangers of sham contracting. Sham contracting occurs when an employer disguises an employee as an independent contractor. These arrangements are normally set up by employers to cut costs and avoid responsibility for employee entitlements.

Businesses should be aware that the consequences of creating a sham contract can be severe. The Fair Work Act provides hefty penalties for anyone caught engaging in these sorts of practices.
