The 'RTM' process is reasonably straightforward, but there are certain key steps that have to be followed for the 'Right to Manage' to be valid, and effectively to stop the freeholder being able to challenge the way it's been set up.

So first up, once the eligibility of the building has been assessed and it's definitely eligible, first up is getting 50% of the leaseholders to sign up. Often, that is best done by one of the leaseholders. We can certainly support that process, but it's most powerful if a leaseholder visits or emails or telephones or writes to their neighbours and explains the advantages and what they're trying to achieve and how everybody's going to benefit from the process.

Once we've got signed forms from 50% of the leaseholders, we're then in a process to set up the 'Right to Manage' company.

And the next step is that we have to write formally to anybody who hasn't already signed up, and give them the opportunity to sign up, before a claim notice is served on the freeholder.

We write to everybody, we give them a couple of weeks to respond, and then we're in a position to serve a claim notice on the freeholder.

The claim notice gives the freeholder one month to dispute the claim. And then three months to hand over.

The freeholder can only dispute the claim on very technical grounds. So they would have to be disputing whether the building is eligible, or whether the requisite 50% of leaseholders have definitely signed up.

Assuming we've done the process properly, there shouldn't be any grounds for them to dispute it.

And the leaseholders should get control of the management at the end of the further three months handover period.
