After the Legislature of Mexico refused to approve the shift in cannabis policy by the end of a court-issued timeline, the country's Supreme Court took a step closer to abolishing cannabis prohibition nationwide.

Minister Norma Luca Pia Hernández, a member of Mexico's Supreme Court, has submitted a broad statement of unconstitutionality regarding the country's cannabis regulations. On Monday, the court is set to review the matter.

The statement arrives almost three years following the Supreme Court declaring the ban on the private possession and growing of cannabis to be unconstitutional and ordering legislators to update the policy. In the years following, legislators have progressed legalization measures, but no official measure has been approved.

The fact that the court is considering this move, which would void provisions of the Mexican Constitution that punish persons for using cannabis, is encouraging to activists. They have stressed, however, that this does not exonerate lawmakers of their duty to devise standards for a recreational cannabis manufacturing and supply network.

For cannabis prohibition to be reversed, at least eight Supreme Court ministers must rule in support of approving the judgment of unconstitutionality.
