The Chhattisgarh High Court has dismissed a batch of writ petitions filed by several candidates of the Civil Judge (Junior Division) Examination-2024, including Public Prosecutors and Assistant Public Prosecutors, who were denied admit cards on the ground that they were not enrolled as “Advocates” with a Bar Council on the date of the examination advertisement. The petitioners contended that since they had been permitted to submit applications, the subsequent denial of admit cards was arbitrary and violative of Articles 14 and 16 of the Constitution.

A Division Bench comprising Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru declined to interfere, expressing clear reluctance to entertain the challenge. The Court strongly criticised the petitioners’ attempt to bypass the prescribed eligibility criteria, characterising it as an effort to secure a “backdoor entry” into judicial service. It held that mere permission to apply does not confer any vested right to appear in the examination if the essential qualifications are not met as on the cut-off date.

Rejecting the constitutional challenge, the Bench observed that a “bald plea” under Articles 14 and 16, without demonstrating lack of legislative competence, manifest arbitrariness, or violation of constitutional guarantees, cannot succeed. The Court emphasised that disagreement with policy choices—particularly eligibility conditions for public employment—is not a permissible ground for judicial review. Consequently, the denial of admit cards to candidates not enrolled as advocates on the relevant date was upheld.
