This video is based on Section 5 of Transfer of Property Act, 1882.
Case Laws covered in this video, are:
Sunil Sidharthbai v. Commissioner of Income Tax, 1986 Honorable Supreme Court observed that transfer of property means passing of a right in the property from one person to another.
Pramatha Nath v. Pradyumna it wa held that an idol, however, a juristic person and capable of holding property, is not a living person and therefore, a dedication of a property to an idol is not a transfer and need not be made in writing or by a registered instrument u/s 123 of the Act.
Jugalkishore v. Raw Cotton Co. Ltd. 1955, the Supreme Court held that the words in “present or in future” means the word “coveys” and not the word “property”. When a future property is transferred, the transferee does not get that property or interest therein. Transfer of any non-existent or future property operates only as a contract which may be performed in future and can be enforced as soon as the property comes into existence.
