You are a member of the jury. What the attorneys say is not evidence. You must review all evidence - watch the entire video. This is what is required of an actual juror. Watch it again and then you will be asked to deliberate and reach a verdict.

Video Description:
This video presents police body cam footage from multiple angles involving a law enforcement response at a trailer park. A call was made regarding an individual on the property. Police arrived, spoke with witnesses, and engaged with the young man who was ultimately arrested and charged with:

Battery on a Law Enforcement Officer (2 counts)

Domestic Violence Battery

Your role as a viewer is to evaluate this video as if you were a juror in a Florida courtroom.

FLORIDA JURY INSTRUCTIONS – BATTERY ON A LAW ENFORCEMENT OFFICER
To find someone guilty of Battery on a Law Enforcement Officer, the State must prove the following five elements beyond a reasonable doubt:

The defendant intentionally touched or struck the officer against their will;

The victim was a law enforcement officer;

The defendant knew the victim was a law enforcement officer;

The victim was engaged in the lawful performance of their duties;

The officer was lawfully performing those duties at the time.

If any of these elements are not proven beyond a reasonable doubt, your verdict must be Not Guilty.

FLORIDA JURY INSTRUCTIONS – DOMESTIC VIOLENCE BATTERY
To prove Domestic Violence Battery, the State must prove the following two elements beyond a reasonable doubt:

The defendant intentionally touched or struck the alleged victim against their will;

The alleged victim was a family or household member of the defendant.

A touching must be intentional and unwanted. Accidental or non-consensual contact without intent does not qualify.

FLORIDA JURY INSTRUCTION – REASONABLE DOUBT
A reasonable doubt is not a mere possible, speculative, or imaginary doubt.
If, after carefully considering all the evidence, you do not have an abiding conviction of guilt, or if your belief is unstable or wavers, then the charge is not proven beyond a reasonable doubt.
The law does not require proof that overcomes all doubt—only reasonable doubt.

VIDEO FOOTAGE:
You have been shown video footage admitted into evidence. This video may not contain the entire interaction or full context of the incident. You are to consider this evidence along with all the other testimony and exhibits in this case. Do not speculate about what might have occurred outside the portion shown. It is your duty to weigh the evidence presented and determine what weight, if any, to give the video recording. There are multiple cameras depicting some of the same information but different cams may depict different audio and video. You are the fact finder so must watch and consider all the evidence.

WEIGHT OF EVIDENCE:
Florida Standard Jury Instructions – Criminal

"It is up to you to decide what evidence is reliable. You should use your common sense in deciding which is the best evidence, and which evidence should not be relied upon in considering your verdict.

You may find some of the evidence to be not reliable, or less reliable than other evidence.

You should consider how the witnesses acted as well as what they said. Some things you should consider are:**

Did the witness seem to have an opportunity to see and know the things about which the witness testified?

Did the witness seem to have an accurate memory?

Was the witness honest and straightforward in answering the attorneys’ questions?

Did the witness have some interest in how the case should be decided?

Does the witness’s testimony agree with the other testimony and other evidence in the case?

Has the witness been offered or received any money, preferred treatment, or other benefit in order to get the witness to testify?

Had any pressure or threat been used against the witness that affected the truth of the witness’s testimony?

Did the witness at some other time make a statement that is inconsistent with the testimony he or she gave in court?

You may rely upon your own conclusion about the witness. A juror may believe or disbelieve all or any part of the evidence or the testimony of any witness."

Watch the footage closely. You may review it as many times as needed—just like a jury in deliberation.

Ask yourself:

Was the officer’s use of force justified or excessive?

Was the defendant resisting, or reacting to an unlawful command?

Did law enforcement act within their legal authority?

Do the actions meet the legal definitions outlined above?
