-Who’s covered by the Florida lien statute?
1. Those who provide professional services, including architects, landscape architects, interior designers, engineers, surveyors, and mappers
2. Those who provide subdivision improvements
3. Materialman, laborer, contractor, subcontractor, sub-subcontractor

-What are the contract requirements under Florida lien law?
Contracts can be oral or written. Contractors must be properly licensed for the work performed, pull proper permits for the work performed, and have the mandatory disclosures for Florida contracts.

-What are the Notice to Owner requirements in Florida?
Subcontractors, sub-subcontractors, materialmen, and laborers must send a Notice to Owner in the statutory form. They can serve it anytime between contract and 45 days after first furnishing of labor, services, or materials, but before the final payment made after the contractor’s final affidavit.

-When is the first furnishing date for specially manufactured goods?
First furnishing is when you start making it, not when you are on site.

-How do I record a Mechanics Lien in Florida?
You can only include amounts for work that is completed. This is different from the total amount of money you may be owed under the contract.
Your Florida mechanics Lien must be recorded within 90 days of final furnishing or termination of the contract. It must be mailed to the property owner.
You must also mail your final payment affidavit 5 days before filing a lawsuit.

-How do I release my Florida Mechanics Lien after I get paid?
You must provide a written lien release. You cannot be required to provide a form other than the statutory form unless the contract calls for it.

-What does the Florida Construction Contract Prompt Payment Law mandate?
Payments must be made within 14 days of request unless a different timeline is stated in the contract.

-What are the important statutes to know for public projects?
Payments must be made within 20-25 days for local government projects. A contractor must pay downstream contractors within 7-10 days. Payments must be made within 75 days of final approval on public transportation projects.

-How do you determine the substantial completion date?
Substantial completion shall be achieved as of the date the work passes its final building inspection. The existence of a punch list or punch list items to be completed shall not be grounds to dispute or withhold any amounts due as a result of achieving substantial completion.

-What does Florida's Consumer Collection Practices Act mandate?
One can’t pretend to be a governmental agency; threaten force or violence; disclose it to third parties; communicate in a harassing manner; use profane, obscene, vulgar, or willfully abusive language in communicating; claim, attempt, or threaten to enforce a debt when it’s know it’s not legitimate; public or post that the person is a deadbeat; communicate between 9 pm and 8 am; or communicate with someone who is represented by an attorney.
