NOTICE OF NONPAYMENT

1. A notice of nonpayment secures a subcontractors or suppliers right to get paid on a project that is bonded. (00:21)

3. A project can be bonded if it’s a private job or if it’s public job. (00:41)
4. The information of whether a project is bonded is generally recorded in the county where the work is being performed. (00:47)

If you are contracted directly with the General Contractor you not required to send a notice to owner/notice to contractor to secure your bond claim rights however, it’s good business practice to send a Notice to owner/notice to contractor even if you are contracted directly with the General Contractor. 6. If you are not contracted directly with the General contractor a Notice to Owner/Notice to Contractor needs to be received by the required recipients by the 45th day from first furnishing labor or material to the project. (01:16)

8. A Subcontractor or Supplier has only 90 days from last furnishing labor and/or material to send a Notice of Nonpayment. (01:38)
9. A Subcontractor or Supplier has only one year from the last day of furnishing labor or material to the project to file suit against the bond. (01:52)

Caution
Don’t confuse a foreclosure deadline on a lien with the notice of nonpayment against the bond.
On a lien - You only have 1 year from the last day of the recording of the lien to foreclose on the lien.
For a notice of nonpayment, you only have 1 year from the last day you furnishing labor or materials to the the property.
