It is common for someone to establish a trust and give the trustee the discretion to make distributions to a beneficiary for the beneficiary's health, education, maintenance, and support. This standard is commonly referred to as the HEMS standard.

Some who set up these trusts wish to restrict distributions by requiring that the trustee first consider income and resources available to the beneficiary. Others tend to want to open up distributions for any reasonable request notwithstanding other income or resources available to the beneficiary.
