81. Transfer Of Cases

This video is about transfer of cases from one court to another court with respect to Civil cases. Section 24 and 25 of the Code of Civil Procedure. under section 24 of CPC the High court and the District courts will have power to transfer the cases within the state and within the district. The district court can transfer any case( suit,petition or appeal) from one court another court within the district. where as the High court can transfer any case from one district to another district within the state and Section 25 Empowers Supreme Court of India to transfer any case pending Before any High Court to any other High Court. Supreme Court of India not only transfer the cases pending before the high court, but also can transfer the case pending before any court including subordinate courts.
The said courts can transfer the cases by an application moved by any party or suemoto.
