WASHINGTON, D.C. — Tensions flared on Capitol Hill as the House Judiciary Subcommittee on Oversight of the Office of Special Counsel *Jack Smith* held a fiery hearing on Thursday, January 22, 2026. Former Special Counsel Jack Smith
Smith claimed Trump willfully stored highly sensitive documents in unsecured locations, including a ballroom and bathroom, and repeatedly attempted to obstruct justice. He also addressed controversial requests for congressional call records related to January 6, calling them standard investigative practice.
“Based on his testimony today, there is no question that Deranged Jack Smith should be prosecuted for his actions,” Trump wrote. “He destroyed the lives of many innocent people, which has been his history as a prosecutor. At a minimum, he committed large scale perjury!”
All the while, Smith told the committee his investigations were nonpartisan — and that there were, indeed, grounds to bring two federal indictments against Trump during the period between his two terms in office.
“I made my decisions without regard to President Trump’s political association, activities, beliefs or candidacy in the 2024 election,” Smith told the congressional panel.
“President Trump was charged because the evidence established that he willfully broke the law — the very laws he took an oath to uphold.”
But Smith’s mandate was particularly sensitive. He was charged with investigating Trump, Biden’s 2020 election rival whom the Democrat would face again in the 2024 race.
Nevertheless, at Thursday’s hearing, Smith defended the indictments and suggested his cases would have been successful had the circumstances been different.
“I want to be clear: I stand by my decisions as special counsel, including the decision to bring charges against President Trump,” Smith told the committee.
“Our investigation developed proof beyond a reasonable doubt that President Trump engaged in criminal activity. If asked whether to prosecute a former president based on the same facts today, I would do so regardless of whether that president was a Democrat or a Republican.”
He added that the evidence compelled him to move forward with the indictments, regardless of the high-profile defendant.
“The law required that he be held to account,” Smith said. “So that is what I did. To have done otherwise on the facts of these cases would’ve been to shirk my duties as a prosecutor.”
Republicans argued the Special Counsel’s actions exposed clear bias, weaponizing justice against Trump for political gain. Smith, however, defended his office, claiming his prosecutions were “nonpartisan” and based on evidence — not politics.
President Trump quickly responded, calling Smith’s record “a disgrace to justice” and urging accountability for what he described as “large-scale perjury” and political persecution.
As the hearing unfolded, sharp exchanges between **Jim Jordan**, **Jamie Raskin**, and other members of both parties showcased the deep divide in Washington over the rule of law and equal justice.
