In our newly launched NYC 'How To...' Series we go over how to fill out an NY DMV MV-104 form. This process has become even more important as the NYPD/police generally are no longer filling out forms or filing reports unless there are injuries, major damage or situations that require police attention (i.e. intoxicated driver) after an accident. For example, previously many NYC TLC drivers and fleets called the NYPD/police after an accident so a police report could be filed and collected a few days later for insurance and other purposes. Recently, the process has changed and the parties involved in the accident are generally expected to collect all the relevant information themselves (i.e. copies of insurance cards, driver license details, vehicle registration, pictures) after an accident and fill out a NY DMV MV-104 within 10 days. If the MV-104 is not filled out and sent within 10 days of the incident, a driver could have his or her license suspended!

✔ If the accident caused property damage only, you must exchange information about your driver license, insurance, and registration with the involved drivers and file the MV-104.

✔ If a person is injured or killed, you are required by the NY State Vehicle and Traffic Law to immediately notify the police and file the MV-104.

✔ If a parked vehicle or other property is damaged, or if a domestic animal is injured, you must locate the owner or contact the police.

✔ It is a crime to leave the scene of an accident that causes personal injury or death.

To get a copy of the MV-104 report after you've sent it in, see below:

⭐️ Call or visit the local police agency or precinct where the accident occurred. Ask the agency if your report is available and what the fee is.
