Suppose a breeder owned several large, aggressive dogs, one of which he negligently allowed to escape its pen. Earlier that day, a farmer negligently left her donkey tied by a roadside, where she should’ve foreseen that it would be in danger. The escaped dog attacked and killed the donkey, and the farmer promptly sued the breeder. At trial, the jury found both parties to be at fault for the loss of the donkey.
