Intellectual property is the principal asset of most U.S. companies, and the financial viability of most businesses depends on their ability to protect intangible assets. This is especially true for technology startups. The decision of whether information is patentable is not a simple one. Some types of information are only valuable if they remain secret. Even when information can be protected by a patent, there is a critical need to preserve secrecy during the research and development phase and until a patent is issued. In this Noontime Knowledge session, we will explain how the law defines a trade secret, how the law protects trade secrets, what you need to do in order to preserve this protection and, more generally, what corporate environment you should strive to create to preserve valuable information. We will also briefly discuss what it takes to recover for misappropriation of your trade secrets.
Sivan Korn has been practicing as a commercial litigator for over 20 years. She started her career in New York City, where she practiced as an antitrust and patent litigator with Axinn Veltrop & Harkrider and Orrick, Herrington & Sutcliffe. Sivan has lived and practiced in Tucson since 2005. She represents clients in a variety of commercial disputes with a focus on intellectual property issues. Among other cases, since 2015, Sivan has been representing an Arizona-based technology company in a multi-million-dollar license dispute with a leading pharmaceutical company, involving the development of biotechnology used to manufacture diabetes medications. Sivan has been recognized among the Best Lawyers in America (Trade Secrets Law) for 2019-2022 and is a member of the American Law Institute.
