“Look, she wasn’t allowed to put in her defense. If her defense is, and her defense was, that she did what she did because she felt she had a duty to do it, and she wasn’t able to put that in as evidence, then of course she comes out with a conviction against her. She couldn’t put in her defense.”

4. SOUNDBITE (English) Peter Ticktin, attorney for Tina Peters:
“I mean nine years for something that caused no harm to anybody, for somebody that never got in trouble before, not even a traffic ticket. To do that to a 69-year-old lady, now she’s been in jail over a year, in prison, and its horrific circumstances.”

6. SOUNDBITE (English) Peter Ticktin, attorney for Tina Peters:
“And to be mixing people who are white collar people who aren’t involved in violence, aren’t involved in drugs, aren’t t involved in crime, and put those people in the same institutions as the maximum security people is horrible. The state of Colorado better do something about its prison systems because you’re in trouble with that. They’re terrible. And that’s where Tina Peters is.”

8. SOUNDBITE (English) Peter Ticktin, attorney for Tina Peters:
“I might be right, I might wrong, but I think that Governor Polis is going to give clemency. So I think in terms of the sentencing that’s going to, I think it might, for whatever purposes, still go forward, and the rest of the appeal still goes forward because he’s not giving an appeal. He’s going to give a pardon, rather, which would get rid of everything. I think he’s just going to give clemency.”

STORYLINE:
A Colorado appeals panel on Wednesday seemed skeptical that a judge could use former county clerk Tina Peters’ insistence on spreading election conspiracy theories as part of the reason to sentence her to nine years in prison for orchestrating a data breach of election equipment.

The three-judge panel was dismissive of many of the arguments made by Peters’ attorneys. But they grilled the state’s lawyer over the trial judge reciting Peters’ false statements about elections in handing down her sentence.

Appeals Judge Craig Welling said Peters could not be punished for her First Amendment rights.

The remarks are significant because President Donald Trump has embraced Peters, who was trying to find evidence of the fraud that he continues to claim, without evidence, caused him to lose the 2020 presidential election. He’s threatened Colorado with “harsh measures” if it does not release her and even issued a pardon of her last month, although she was convicted on state crimes that he cannot erase.

Peters’ lawyers have argued the president has a right to pardon people who committed crimes to carry out federal duties, such as preserving election information. But that argument did not even come up during oral arguments as they appealed her sentence Wednesday.
