Govt’s U-turn

The federal government has taken a U-turn as the newly-promulgated the National Accountability (Amendment) Ordinance, 2023, not only carries the changes that the ruling coalition opposed when it was in opposition but sparks concerns of political manipulation. Since, coming into power in April 2022, the ruling coalition has made multiple amendments in the anti-corruption law but the changes made through the new ordinance suggest that anti-graft watchdog is once again being used as a “tool for political engineering”.

Taking advantage of the absence and to avoid potential objections of President Dr Arif Alvi, who is considered a loyalist to ex-premier Imran Khan, Senate Chairman Sadiq Sanjran being the acting president embraced several amendments through the stroke of a pen to the NAB Ordinance of 1999 solely to target the only opposition party in the country – PTI. Among the major changes, the government has shifted the burden of proof on the accused as the ordinance states that the courts can award sentence on the basis of presumption unless proven otherwise.

Chairman NAB can also issue warrant of arrest during the course of inquiry if the accused is not joining inquiry despite notices or willfully does not cooperate in such inquiry. In addition, NAB has been given power to detain an accused for 30 days instead of 14 days – an amendment which the ruling coalition would cry foul for when in opposition.
