Описание к видео How to deal with police | पुलिस बिना वजह मारे तो क्या हम भी मार सकते हैं? |

A Police officer who beats an accused in his custody can be imprisoned and/or suspended or terminated from service. You can also demand compensation for mental, physical and/ or financial harassment. Beating a person unreasonably is a gross violation of fundamental rights and you can directly approach High Court u/a 226 of constitution for such action.

A police officer has to strictly adhere to the whole procedure as described u/s 41, 46, 49, 50, 51, 53, 53A, 54 and 57 of the Code of Criminal Procedure (whichever is applicable at the time) while arresting or detaining a person because a minor non-compliance of any procedure by him can cause the whole process to be suspicious and it will definitely cause serious trouble to him.

Some common rules which are to be mandatorily followed by a police officer while making an arrest:

Police officer can arrest you without warrant in case of a cognizable offence (offences of higher degree). He has no right to arrest you without written permission from magistrate in case of non-cognizable offences (offences of lower degree) – Section 41 CrPC
Forget about beating, unless you are not restraining, a police officer cannot even touch you while arresting. Even if you are restraining, the force used must be justifiable. – Section 46 and 49 CrPC
Women’s cannot be arrested after sunset and before sunrise. If it is eminently necessary to arrest then there must be permission in written from magistrate. Also, only lady policemen can arrest women. – Section 46 CrPC
It is illegal for policemen to restrain or detain you without arresting. – Section 49 CrPC
Police officer when arresting without warrant shall forthwith communicate to the accused person full particulars of the offence for which he is arrested. If the case is bailable, then the accused must be informed of his right to get bail. – Section 50(1) and 50(2) CrPC
Arrested person has right to consult to a lawyer of his choice, on the police officer that a friend, relative or any nominated person of the arrested person must be informed about his arrest and also to inform him about his rights. A magistrate is also under obligation to satisfy himself about the compliance of police in this regard. – Section 50A CrPC
A person arrested must be produced before an magistrate within 24 hours of arrest. It police officer arrests you on Saturday and produces you on Monday before magistrate then he is violating your fundamental rights, because Judges are on Duty 24*7. – Section 57 CrPC
In Indian legal system we follow the principle of presumption of innocence i.e., a person will be called innocent even if he has done most heinous form of a crime even in front of a magistrate, until the whole process is not followed and he is not held guilty by a court of law.
You are running from detention,
You are carrying on any riotous activity that it is eminent necessary for an officer to arrest and use force against you to avoid failure of law and order,
You are a part of unlawful assembly and protesting violently,
You are breaking Curfew imposed by District Magistrate.
Now you will say I am preaching what is written in books and the reality is different. Indeed the reality is different but it is so because of two reasons.

Firstly, people are not aware of their rights. They consider police as the supreme lord and do whatever they say. A person gets terrified even if a constable threatens to cause trouble for him.

Secondly, the mentality of society towards police and legal system is what makes the difference. But somewhere it is also the fault of our lengthy procedural law and corruption in system which causes people to have such opinion.

Now, it is evident that they will deny doing so. Then now, submit a written application stating all your grievances to the Police Chief of your district (SP, DIG of Police or Commissioner of police) and get seal and signature of his office on your application. Even if he is not listening, submit a written application to the magistrate about your grievances. Even if he is not listening then approach to the Sessions Court of your district or you can now directly proceed to the High Court. You can take help of a lawyer when approaching the courts. (Denying to register an FIR is a Crime u/s 166A of IPC and that police officer can be punished with rigorous imprisonment upto 3 years for doing so.)

Always remember one thing, when you are arrested for any reason, it is an attack on your personal liberty enshrined in Article 21 of Constitution.
