Once upon a time, in 19th-century England, a man built a reservoir and filled it with water. The reservoir failed, and the water flooded coal mines belonging to the man’s neighbor. Was the man liable to his neighbor even if he’d taken every reasonable precaution? That’s the question in Fletcher versus Rylands.

John Rylands built a reservoir to supply water to his mill. Rylands hired a competent engineer and contractors to plan and build the reservoir. Unbeknownst to Rylands, the reservoir was built above several old mineshafts, filled in with dirt, that connected to abandoned underground coal mines. These abandoned mines connected, in turn, to operational mines run by Thomas Fletcher on nearby land.

One of the old mineshafts collapsed, and the completed reservoir burst as it was being filled with water. The water flooded through the old shafts and abandoned mines, inundating Fletcher’s working mines. The flood’s effects ultimately forced Fletcher to abandon his mining operation.

Fletcher sued Rylands for damages from the loss of the mines. The Court of Exchequer ruled for Rylands, concluding that he hadn’t been negligent. Fletcher appealed to the Exchequer Chamber.
