There is no way WBD is not doing this on purpose, they are playing stupid and beating around the bush. They even rejected Amazon, Paramount, and Netflix's offers to distribute the movie. If they keep abusing the tax system to constantly write off content for ignorant reasons, they will see what happens. This is not how to handle a merger or run a company.
