Supreme Court of India passed a crucial order in the Bihar Special Intensive Revision (SIR) matter that could impact millions of voters across the state. The Court directed the Election Commission of India (ECI) to treat Aadhaar card as the 12th valid document for the purpose of inclusion in the revised voters list of Bihar.

This means that from now onwards, Aadhaar can be used as a stand-alone document, just like the other eleven identity proofs already accepted by the Election Commission. The order is particularly important because it simplifies the process for people who only possess Aadhaar and no other documents.

However, the Court also made it crystal clear that Aadhaar is NOT proof of citizenship. This clarification is vital because many had been under the misconception that Aadhaar alone could serve as proof of nationality. The Court, relying on the Aadhaar Act and the provisions of the Representation of the People Act, 1950 (Section 23(4)), stressed that Aadhaar may be used only to establish identity, not citizenship.

The judgment also directed the Election Commission to issue fresh instructions to its officials on the ground level, making sure they accept Aadhaar cards when people apply for inclusion in the voters list. At the same time, the officials are allowed to verify the authenticity and genuineness of Aadhaar cards produced by applicants, in order to prevent misuse or fraudulent entries.

This decision comes in the backdrop of Bihar’s Special Intensive Revision drive, which is a large-scale effort to clean up, correct, and update the voters list ahead of upcoming elections. By allowing Aadhaar as an additional document, the Supreme Court has sought to ensure wider voter inclusion while balancing the concerns of citizenship verification.

For the people of Bihar, this order means easier access to the electoral process, fewer rejections due to lack of documents, and a more transparent system. For the Election Commission, however, it brings both opportunity and challenge—opportunity in terms of simplifying processes, and challenge in terms of preventing fake or duplicate Aadhaar misuse.

The bottom line: Aadhaar card can now be used for voter registration and inclusion in the electoral roll in Bihar, but it will not and cannot be treated as proof of Indian citizenship.
