Natural Justice

The term natural justice signifies basic principles of justice, which are made available to every litigant during trial. The maxim of audi alteram partem which implies the right to be heard) and nemo judex in causa sua which means no person may judge their own case are the most prominent principles of natural justice.

Principles of Natural Justice
The principles of natural justice constitute the basic elements of fair hearing, having their roots in the innate sense of man for fair play and justice which is not the perverse of any particular race or country but is shared in common by all men.

The 3 principles of natural justice concern procedural fairness and ensure a fair decision is reached by an objective decision maker.

Basic Pillars of Principles of Natural Justice

Nemo in propria causa judex esse debet
No one should be made a judge in his own case, or the rule against bias.

Audi alteram partem
Hear the other party, or the rule of fair hearing, or the rule that no one should be condemned unheard.

Jus naturale
Jus naturale is a system of law based on fundamental ideas of right and wrong.

Procedural fairness
Procedural fairness is a legal principle that ensures fair decision making. It has developed over time as a result of decisions by the courts in administrative law cases.
